These Terms of Service (“Terms”) govern your use of the Tezga mobile application, website, and related services (collectively, the “Tezga Platform”). The Tezga Platform is owned and operated by Tezga LTD (“Tezga,” “we,” “our,” or “us”). By creating a Tezga account, booking an artist, or offering services as an artist (“Artist”), you agree to be bound by these Terms.
1. Scope of Service
For Users: Tezga allows registered users (“Users”) to search, communicate with, and book performing artists (“Artistas”).
For Artistas: Tezga provides a platform for artists to publish profiles, manage availability, set service and travel fees, and receive bookings.Tezga acts solely as a marketplace and payment facilitator.
Tezga LTD does not provide or manage artist services directly.
2. Account Registration
To use the Tezga Platform, you must create an account and provide accurate, current information.You are responsible for maintaining the confidentiality of your login credentials and all activity on your account.Accounts may be suspended or terminated by Tezga if these Terms are violated.
3. Bookings and Payments
When a User confirms a booking with an Artista, a direct service agreement is formed between the User and the Artista.
Billing Structure:Users pay for: (a) the Artist’s service fee, (b) travel fees (if applicable), and (c) applicable taxes.Tezga collects payment from the User on behalf of the Artista.After the service is completed, Tezga deducts the Tezga Fee (commission) and transfers the remaining balance to the Artista. Payment processing is managed through Tezga Payments, a Tezga LTD entity.
4. Service Fees and Tezga Fee
Tezga charges a commission (“Tezga Fee”) on completed bookings. The Tezga Fee is deducted automatically from the User’s payment before funds are released to the Artista. The applicable Tezga Fee is disclosed to Artistas in advance. Fees are non-refundable unless otherwise required by law.
5. Cancellations and Refunds
Cancellation policies are set by the Artista and displayed on the booking page. If a User cancels, the applicable refund depends on the Artista’s cancellation policy. If an Artista cancels, the User is entitled to a full refund. Tezga may, at its discretion, issue refunds in cases of force majeure events (e.g., illness, travel disruptions, natural disasters).
6. Responsibilities of Users and Artistas
Users must provide accurate booking details and comply with the Artista’s requirements.
Artistas must honor accepted bookings, deliver the agreed services professionally, and comply with applicable laws, including tax obligations. Both Users and Artistas agree not to use the Tezga Platform for unlawful, harmful, or discriminatory activity.
7. Reviews and Content
Users and Artistas may leave reviews after a booking. Reviews must be honest, respectful, and non-misleading. Any content uploaded to Tezga (bios, media, reviews) must comply with Tezga’s Content Policy.
Tezga reserves the right to remove inappropriate content.
8. Intellectual Property
Tezga LTD owns the Tezga Platform, App, including software, trademarks, and branding.You are granted a limited, non-exclusive license to use Tezga for personal or professional bookings.No rights are transferred to you except for the limited use license.
9. Liability and Disclaimers
Tezga LTD is not a party to agreements between Users and Artistas and does not guarantee the performance or quality of services.The Tezga Platform is provided “as is” and “as available.”To the maximum extent permitted by law, Tezga’s liability is limited to the greater
of:
a) the total Tezga Fee paid by you in the 12 months prior to the claim, or
b) USD $50. Artistas act as independent contractors and are not employees, agents, or representatives of Tezga.
10. Termination and Suspension
Users and Artist may delete their accounts at any time. Tezga may suspend or terminate accounts for violations of these Terms, non-payment of fees, fraudulent activity, or legal reasons.Termination does not entitle Users or Artistas to a refund of service fees.
11. Dispute Resolution
For Users in the European Economic Area (EEA), Switzerland, or the UK, you may access the European Commission’s online dispute resolution platform. Tezga LTD is not obligated to use alternative dispute resolution entities.For Users in the United States, these Terms include a binding arbitration agreement and class action waiver. Please review carefully.
12. Governing Law
If you are based in the EEA, UK, or Switzerland, your local consumer protection laws apply.For all other Users and Artistas, these Terms are governed by the laws of England and Wales, without regard to conflict-of-law provisions.
13. Changes to Terms
Tezga may update these Terms from time to time. If material changes are made, Users and Artistas will be notified in advance. Continued use of the Tezga Platform after such changes constitutes acceptance of the updated Terms.
